Terms and Conditions

TERMS & CONDITIONS

This Client Agreement ("Agreement") contains the terms and conditions between us, Brooklyn Music Lessons, LLC ("Brooklyn Music Lessons", "BML") located at 130 Diamond Street, #4B Brooklyn, NY 11222 and you ("Client"), regarding your application and participation as a Client of Brooklyn Music Lessons. This Agreement will be effective as of the date you click the "Create Account" button (the “Effective Date”). Please read these terms and conditions carefully as they constitute a legal agreement between you and our company. By checking "I Agree to the Terms and Conditions" box and clicking the "Create an account" button, you agree to be bound by all of the terms and conditions set forth in this agreement relative to your participation as a Client.

PAYMENT

All payments must be made directly to Brooklyn Music Lessons through BML's online payment system; in no circumstances are payments to be given to Teachers. Introductory Lesson and Master Class payments are processed through Authorize.net at http://brooklynmusiclessons.com/intropayment. Client access is enabled upon account registration and approval. Client must purchase lesson credit at least 24 hours before attending Introductory Lesson or Master Class. Payments for students wishing to continue with lessons after completing Introductory Lesson are processed through Authorize.net at http://brooklynmusiclessons.com/continuing. Client access is enabled upon completion of Introductory Lesson. Client must purchase single lesson credits and/or package lesson credits at least 24 hours before attending Continuing Lesson or Master Class in order to confirm the appointment.

CANCELLATION

BML reserves the right to cancel a lesson for any reason. When possible, BML will give Client notice at the beginning of the month and a credit will be issued for the cancelled lesson.

Clients who need to miss a single lesson must contact Teacher with at least 24 hours in advance by phone or email, excepting legitimate emergency situations. Cancellations with less than 24 hours notice result in forfeiture of that lesson's credit.

NON-SOLICITATION

Client agrees not to directly or indirectly solicit their Teacher for lessons and acknowledge that such action constitutes a breach of this Agreement and that Teacher is prevented from conducting lessons for Client independently of Brooklyn Music Lessons.

SUPERVISION

A parent or legal guardian must be on site for the duration of every lesson for a child under the age of 18. Teacher will not continue a lesson if there is no parent or guardian in the home and no refund or credit will be granted for that lesson. Teachers will not provide supervision beyond the time limits of the scheduled lesson.

POLICY CHANGES

BML will give Client 30 days advance notice of any policy changes.

LIABILITY

Client releases BML, our Teachers, officers, directors, any parent and subsidiary or other affiliated entities, and its Teachers, from any and all liability and responsibility in any case of personal injury, property damage or loss, injury, accident, or misconduct. Our liability to Client for any cause whatsoever (including, but not limited to, those arising out of or relating to this Agreement) and regardless of the form of action, shall not in any event exceed the lesser of (a) the actual amounts paid by Client to BML or (b) one hundred dollars. In no event shall BML be liable to client for indirect, incidental, special, or consequential damages, which are hereby excluded by agreement of the parties regardless of whether such damages were foreseeable or whether either of us has been advised of the possibility of such damages.

SPECIFIC PERFORMANCE

Client agrees with BML that if this Agreement is breached, irreparable damage would occur, no adequate remedy at law would exist and damages would be difficult to determine, and BML shall be entitled to specific performance of the terms hereof or injunctive relief, in addition to any other remedy at law or equity.

MISCELLANEOUS

This Agreement shall be governed by and construed, interpreted and enforced in accordance with the laws of the State of New York. You may not assign this Agreement without our prior written consent. If any term, provision, covenant or restriction of this Agreement is held to be invalid, the remainder of the terms, provisions, covenants and restrictions of this Agreement shall remain in full force and effect and shall no way be affected. This Agreement constitutes the entire agreement between Client and BML and there are no other agreements, understandings, representations or warranties among the parties on the subject matter hereof. This Agreement may not be altered, modified or amended except by a written instrument signed.
